Green card through marriage

My b/f is not a U.S. citizen, while i am. We got married, but shortly he had to leave for this home country due to family medical emergency. While there he got drafted into the army where he is currently serving. What are the procedures for me to begin the green card application process while he is still in the army?

The answer to your question depends on when your husband was last in the United States, his visa status and how long he stayed here before leaving. You would be able to begin the petition for him as a relative of you, but you should discuss his eligibilty for a green card with an immigration attorney.

In which army is he?

In which army he is serving may also be relevant. If he is in an army of a country that is fighting the US, he may have problems getting a visa into the US.

You may submit a relative petition, however you must provide more information as to his status before you got married.
