Legal Question in Immigration Law in New York

I'm an illegal immigrant and I came here when I was 14. I was caught for shoplifting 5 years ago when I was 21 in NY. The merchandise was worth about $40 dollars. This was my first offense ever. I was arrested and went to jail for like 7 hours and released with a court ticket. The case was dismissed and there was no fine or community service. CAn my record be expunged ? Am I still eligible for Obama's deferred action ? I'm really regreting my stupid behavor. Please help me.

Yes the deferred action plan will not deny you unless you are convicted of a felony or a significant misdemeanor. You got a violation and would not even count as a felony. You would not even need to report it.
