Legal Question in Immigration Law in New York

here illegally

I came here illegally in 2000 (i.e., without a visa) and I've been here ever since. Is there anyway to apply for legal status. If I get married will I be eligible for a green card or do I have to go home first and then apply. thanks

You have some of the answers but your case is the type of case where you must sit face-to-face with an attorney for confidential advice on steps you should take to change your status. Marrying a U.S. citizen or a permanent resident is not likely to guarantee you protection from deportation.

The answer to your question depends on whether or not an application was filed for you or your parents with USCIS or the Department of Labor prior to April 30, 2001. Similarly, the answer will depend on whether there is someone who would be able to file a petition with you. You should seek the advice of an immigration attorney who can help you determine your eligibility to apply for lawful status in the United States.
