Legal Question in Immigration Law in New York

Immigration

My husband and I went for our first interview with INS. We were in there less than 5 minutes. Only a couple of questions were asked - - very vague questions. They said that they are still conducting a security clearance and that I should hear something within 3-6 months. They wrote ''pending'' in my passport. Is this normal?

Re: Immigration

Yes, this is "normal." The USCIS takes a few months to get the security clearances done. However, what is NOT normal is if you have waiting an unreasonably long time to get an answer on your application. In that case, you should consider filing a mandamus in a federal district court to compel the USCIS to promptly adjudicate your application.

Our office has extensive experience with mandamus actions, and should you wish to consult with us, we would be happy to help.

Good luck!
