Legal Question in Immigration Law in New York

Traveling

I want to travel outside of the USA while i am awaiting approvel for my adjustment of visa status, is this possible, or do i have to be in USA untill everything gets approved. Is there a certain form I can file in order to travel back to my home country while all the paper work is still in progress?

Re: Traveling

You have not provided enough information in order to answer this question. On what basis have you filed your adjustment of status applicaiton? How long have you been in the United States? What was your status prior to filing your adjustment applicaiton?

I recommend that you discuss the pros and cons of travelling while your adjustment is pending with an attorney.

Re: Traveling

You may travel, however, you must obtain first advance parole, assuming also, that prior to filing for an adjustment you maintained legal status and that you dont have criminal records.
