Legal Question in Insurance Law in New York

Auto accident- medical bills denied

My car was rearended in Buffalo NY in May 2008. The driver of the other car accepted her mistake, Police were notified were at scene, car towed and fixed.Repair bills and rental car paid by other cars insurance. I had neck pain, saw my doctor 2 days later. Saw neurologist 5 months later CT scan normal. The 2 insurance companies and my health insurance are denying the benfits. All this is because I did not notify my Insurance. The medical bils are about $1200. What can I do to get the medical bills reimbursed

Re: Auto accident- medical bills denied

One of the prime responsibilities under a policy of insurance is to notify the company of an incident. Failure to do so is a breach of contract on your part and relieves the insurance company of their obligations.

You might try to appeal the no dault denial through the no fault arbitration unit of the NYS Insurance Department, but otherwise, be glad only $1200 is involved.
