Legal Question in Insurance Law in New York

Personal injury case

I had an accident (lip and fall) due to the negligence of a restaurant and they have admitted fault. How much should I expect to be compensated from their insurance company? I have a sprained ankle and some torn ligaments in my foot. I have 4 kids under5 whom I cannot care for at this time, and my husband has taken off of work to care for us. What is a fair settlement amount? What are my legal rights?

Re: Personal injury case

A personal injury can't be evaluated online. From what you're describing, the pain & suffering aspect could be worth between $5,000 and $100,000. Other elements include past and future medical expenses, wages lost by your husband and other components as well. You did not indicate your zip code or that of the restaurant, but the county you're in can make a difference. Brooklyn and Bronx and New York juries bring in bigger verdicts than Queens or Staten Island or Nassau or, forgive me, Chemung. So you need to engage counsel and get real legal advice (which is not you get here).

Re: Personal injury case

Firstly, you should expect to have all your medical bills paid as well as any time lost at work. Beyond that additional funds may very well be attainable, but you certainly should have attorney representation to ensure that all of your rights are preserved and that you receive as much as possible. This area of law is our specialty, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.
