Legal Question in Intellectual Property in New York

I am a programmer and I am building an android application that gives caller ID behind the scenes my program connects to http//www.whitepages.com with a number and return to me a name and address then I display it for the customer on his phone What I want to know is can I be sued by white pages for using their information and is there a differenc if I charge money for that app or i give it free

You need to carefully read the terms of use that can be found on www.whitepages.com to figure out whether your activity is permissive. You should also inquire whether they have an API that may be available to you.
