Legal Question in Intellectual Property in New York

I am trying to start an Internet business. The business would feature music samples of musical artists, like iTunes. I do not plan to pay for the samples. Is this legal? As long as I have permission of the artist or record company aren't I o.k.? Given the nature of the business I am trying to start what type of lawyer would be best to hire to set up the necessary argreements/contracts I would need?
