Legal Question in International Law in New York

Hi.

A donation made in time of good financial situation can be restituted if the one who made a donation becomes destitute. This is by law in italy and as the donation came from Italy that is the country where the law should prevail.

Is there a procedure I can follow ?

Thank you

First, it is not possible to take back a gift unless you can prove some kind of fraud in the inducement.

That said, if everything occurred in Italy, you will likely have to locate Italian counsel and handle the matter there. If you were solicited for a donation here in the US, then US law and jurisdiction should be the proper venue.

Perhaps you should consult a lawyer in private and explore your options. If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Kind regards,

Frank
