Legal Question in Employment Law in New York

My brother is a security guard in NYC he went on vacation which he submitted a request for and was approved for the time off, while on vacation he receives a call from his supervisor informing him that they gave his postion away to the person who was covering his postion while on vacation. Upon returning from his vacation he was told that he would be sent to a different location and his pay and hours were cut. What can be done legally so he can get his position back.

There is nothing that can be done unless this change violates a collective bargaining agreement (Union rules) or it is a pretext for unlawful discrimination (age, race, nationality, sex (gender), pregnancy, genetic information, sexual orientation (City law).
