Legal Question in Employment Law in New York

My company will be hiring a contract company to take over my department, thus I will be laid off. Severance pay is only offered to those that are not offered a position with the contract company. I probably will not take any position due to salary decreases. Since I will not take the position with the contract company I will not receive any severance pay for my 15 years management experience. This sounds discriminatory but looking for advice
