Legal Question in Employment Law in New York

Cutbacks

I was employed at a warehouse in my hometown. I was an employee for 14 years. In February of this year 3 full time employees were called in to the office and said because they had to cut down they were letting us 3 employees go. This also included a couple people from an employee agency. I had no argument with a a company cutting back but to let full timers go and bring in temps from an angency is wrong. Aside from that before we were let go for cutbacks a temp worker who had worked for us full time before quit and comeback was put back on full time. How can that be fair and is it legal? He has as far as I know passed a drug test and physical which is company policy.

If you can prove that you were let go because of your age (over 40) you may have a claim for age discrimination, however if you do not have an employment contract, and you are let go because of monetary considerations there is no law against such severance.
