I work for a company located in new york, new york. I want to know if for holidays (ie., thanksgiving, new years day, christmas) am i sopposed to get double time pay, because in this office employees are not receiving time and a half for people that work over 40 hours, instead on the paycheck stub, hours worked after 40 hours they are just adding it as a commision so they won't have to pay the extra wage, is that illegal?, if so what can i do about it? and is there a policy on raises?, i was promised an evaluation for raises every six months on october they never followed through with that promise and no one has gotten a raise.

If you are a non-exempt employee working more than 40 hours per week, you are in all likelihood entitle to time and a half overtime compensation per the Fair Labor Standards Act (FLSA). Employers around the US still try to dance around it, but they are getting crushed in Federal Court on a daily basis.
