Legal Question in Employment Law in New York
Is it legal for my Employer to take away Health Insurance from my daughter
Hello,
For the last 11 months I have been trying to have my daughter put back on my Health Insurance provided by my employer. My employer says that I was sent a form to fill out and send back (I never saw any such form)so they canceled the Health Insurance which covered my daughter without any notice to us at all. This list had the names of people that didn't qualify for the Insurance or never sent back the form, and just like I said from the start I never did get this in the mail. After I got this e-mail the Head of Human Resources at my plant said that the list he gave me wasn't the up-to-date list (just as Ithought they would say) so I asked him if I could see the (up to date list) and he said that he doesn't have it. This has caused me much stress thinking what would happen if my daughter was hurt and needed medical treatment. I have not been able to sleep, and I'm now in trouble at work because of missed time, and I wrote a letter stating that this was causing me not to sleep and was affecting my work and my life. I have worked there for the past 30 years and I have raised my daughter on my own for the past 15 years, I NEED HELP!!!!!

I'm not sure I understand the relevanance of the list. Do you have the proper form now? Have you submitted it? An employer is not permitted to interfere with an employee's benefit that she is entitled to, or may become entitled to.
