In NYcan a store manager legally change your time on your time card on a daily basis, to total exactly 40 hrs for the week?

If they are adding time, yes. If they are taking off time, no.

failing to pay hourly employees overtime for each minute over 40 hours is nearly always a violation of the Fair Labor Standards Act (FLSA).
