Salary reductions and selective reinstatements

My company instituted an across the board 5% pay cut last year. It has come to my attention that while the President claims business is no better, select employees have in fact been given their 5% back. Is this selective reinstatement of a give-back legal in NY State?

Employers are permitted to excercise discretion in deciding raises, bonuses, etc., but if the discretion is based on a discriminatory factor then you might have a claim.
