Legal Question in Employment Law in New York

Timeframe to bring suit against Employer

I would like to know what the timeframe or statue of limitations to bring suit against an former large employer that got rid of me thru a mass layoff, but I think that the employer violated anti discrimination acts (I had recently just before being terminated, been on a disability leave). It has been over a year since being terminated but friends have encouraged me to take action if I can. Thanks.

Under federal law, you have two years to file a FMLA action -- three if the discrimination is deemed willful. Keep in mind that there are different state statutes and ADA claims may depend on your state statute.

If you believe you were unlawfully terminated, you should consult with a Severance Attorney who is well-versed in federal law.
