Legal Question in Landlord & Tenant Law in New York

My apartment recently caught on fire. I do not have a lease. The fire Marshall said, the cause of the fire, was a over-loaded socket. I have reported that same socket to my landlord before the fire. My bedroom set and some other furniture was destroyed, my landlord said the insurance company did not pay him for it, however the insurance company did question me about my furniture and belongings. My landlord told me after he fix my apartment, he is not renting it back. He took out my stuff and put it in his backyard, because he said they needed to be moved to fix the apartment. It rained and destroyed my stuff. Now I have no place to stay, and no furniture. What can I do?

You have a valid lawsuit against the landlord for both your property and the apartment. You should get a new apartment to live. The difference in the rent during the lease term would be your damages. You should photograph your ruined furniture. If possible, you must find receipts or documents demonstrating the original purchase price of the furniture. If not, you must retain receipts for original replacement furniture.
