Legal Question in Landlord & Tenant Law in New York

Back in August, my landlord and i were in court for non-payment of rent. I could not come up with the amount required by the date ordered, and the landlord then had the right to ask the sheriff for a warrant of eviction. However, he did not, and agreed verbally to let me continue to stay, while paying rent, as long as I tried to get assistance for the rent arrears through DSS. I asked for this in writing but he refused. Since then I have paid monthly rent on time, until this past month when I could not. Now he is threatening the eviction again. Since the judgement was over 4 months ago, is he still able to get that warrant of eviction, or does that expire?

Since you paid all rental arrears under the original agreement, he would have to commence another non-payment proceeding.
