Legal Question in Landlord & Tenant Law in New York

back rent

My landlord sent me a 30 day notice of debtor letter. He sent back my last rent payment because he says he also filed an eviction notice for non payment. Is this legal? Shouldn't I have 30 days to clear up back payments? Shouldn't he have waited to file eviction notice in court.

Re: back rent

If he commenced an action for non-payment, payment in full on the court date will vacate the petition.

If he commenced a holdover proceeding for eviction, even if you pay rent you will still be required to vacate the premises.
