Legal Question in Landlord & Tenant Law in New York

Black Mail

We have been trying to leave a residence for months. Due to family sickness, and other personal problems we have not been able to leave until now. Months ago when our landlord presented us with back water and sewage bills we contacted our attorney who informed us that under our month to month lease we are not responsible for those bills. I never disputed paying rent for the rest of the time here. the landlord came today and we told him we would be out by the end of the week. He is demanding I write him five or six post dated checks to cover the past water and sewage bills or he will have us evicted tomorrow. I know it is against the law to write checks you have no money to cover. Can he Black Mail us like this?

Re: Black Mail

Relax. Eviction proceedings take many weeks and

require a court order after a hearing.
