children of owner moving in

My kids are moving in the basement

of our house by the 1st week of

march.My question is what should I

do since my tenant in the basement

refuses to move out. they have been

staying there without paying

anything since september 2007.

please help! thanks in advance.

There are a number of issues that must be clarified. Are they under lease? Is the apt legal? Either way a summary proceeding for eviction needs to be started immediately and unless tenant vacates voluntarily, it will be imopossible to evict them by March 1. But you need to get the procdure starteed asap. This area of law is our specialty, however, we would need some more information before making a complete and proper determination.
