Legal Question in Landlord & Tenant Law in New York

I am being evicted. I am living a rent stabilized apartment leased by my grandparents. The last one to die was my grandfather, died back in april 2008. Their lease expired in spetmeber 2008. I have not payed rent since his death and just got the eviction notice. My name is not on the lease. I've been living here since I was a child. I had told the landlord I was leaving, and she said it was ok because I had a lot of time. So now it is November 2009 and I owe around $10,000 as the rent is 760 a month. I have about 2 thousand in bank accounts and was juts able to find a job now. I have just today given in my show of cause and it was accepted and my court date is December 1st.

I have an attorney working on this, and what he said was 'the management failed to join my grandparents estate with the lease', so he is hoping that it would have the case dismissed.

What I want to know is if that is possible. Is he doing the right thing? And if this failed, would I get a second chance to appear in court and pay? Would the judge need to see proof before she even allows me to pay?? I want to know if there is any way I can just pay to keep the apartment if someone were to lend me the money because I am going to be homeless if this fails.

Trust you attorney he seems to be giving you more time to pay the back rent and to negotiate with your landlord (the case is likely to be dismissed but the landlord can and is likely to re-file)
