Legal Question in Landlord & Tenant Law in New York

How to Fix an Erroneous Judgement without going to Appeal

Judges Decision awards Landlord monies that he clearly was paid already as per his verified petition. Clearly a mistake by a Judge who was asked to resign or he would be removed from the bench due to ''Substance abuse'' problems. Can I ask the head Judge to Vacate this Judgement due to an irregularity in a vital matter and the fact that the Judge was incapable of giving a fair hearing. The Judgement was just over 4 years ago; is there a statute of limitations as a notice of appeal was timely filed.

Re: How to Fix an Erroneous Judgement without going to Appeal

You must file an appeal. Once a notice of appeal is served and filed, you normally have several months to perfect the appeal (file the brief). 4 years is too long a period of time.
