Legal Question in Landlord & Tenant Law in New York

My landlord, who lives in the 2 apartment duplex along with me, lives above me, and his dogs bark almost nonstop when my landlord is gone, which is usually about 16 hours a day during the week; so I wonder, what can I do about it without having him just tell me to move out then?

Send him written notice that his dogs bark 16 hours a day, and that it is a breach of your warranty of habitability. In the notice write that if the landlord does not give you peace - especially at night - that you will reduce rent paid as an offset to the nuisance and breach of peace.

That letter will get a response.

Mike.
