Landlord refuses handing out copy of lease agreement to tenant

Hello,

My client, a German national, moved into an apartment in Manhattan. His company pays for his rent but requiers a copy of the signed lease agreement. We'd need the landlord signature and the tenant's signature on the lease.

After paying the first month rent & security deposit, we requested a copy. Tha landlord refused and promised to hand over a copy after the tenant has moved in. A month later, the tenant move in. The landlord now says that he won't sign the lease agreement and supply us with a copy until one month into the lease.

We really need a signed lease agreement for the rental allowance.

We are current on all payments and have two well known large companies backing the lease. One of them being GM. I don't understand why the landlord would refuse to hand over the lease agreement. I'm suspicious.

How can we obtain a copy of the signed lease agreement? Can the landlord refuse to sign, although the tenant has already move in?

If he refuses to comply, move by order to show cause in the housing court.

It could depend upon the transactions leading up to the tenants possession. You cannot force the landlord to execute the lease unless it is only a ministerial act due to the prior documents. you can call me at 212 683 8677 for free telephone consultation
