Legal Question in Landlord & Tenant Law in New York

Lease question

Signed a lease for an apartment on July 16th. Gave a check for first month's rent and deposit. Landlord stated, He would mail me a copy of the lease. Decided 12 hours later I did not want the apartment. Contacted Landlord 12 hours later, He told me that it was in cement and I would be paying for the apartment for the year. Help... Can I get out of the lease?

Re: Lease question

There was an offer for you to rent the apartment. The offer was contingent upon your receipt of a written lease agreement. You made the offer but you did not receive the written lease agreement. Therefore, the offer may be withdrawn before there was an acceptance.

I would stop payment on the check and send a certified letter to the landlord that 1. As of date you have not received a written lease agreement and 2. That your offer to lease the apartment is hereby withdrawn.

Mike.
