Legal Question in Landlord & Tenant Law in New York

Management company made an error in permitting sublease renewal

I am currently subletting my co-op to a wonderful tenant. Her lease term is due to expire on Oct 31, 2005. I received an email from the sublet coordinator of the management company on July 11, 2005 which indicated clearly that I have ''an additional'' year remaining to sublet my apartment which will also be the final year, and that a lease renewal reminder will be sent to me sometime in August. I received the lease renewal reminder dated August 25, 2005, and I followed the instructions provided which was to furnish them with a new signed contract, letter to the board, fees, etc. The new lease was signed on Sept 13, 2005 after I got the instructions from the sublet coordinator. I put together the package with all the requirements needed for the renewal, and I sent it to management co. for processing. I then received a phone call from another agent of the management co. telling me that I've exhausted my sublet allowance and that my tenant would have to move out by Oct 31, 2005. I explained to her about the email and the letter that followed which clearly stated that I have one more year left and that I've already signed a new lease agreement with my tenant. She said it was a mistake on the part of the sublet coordinator.

You may have grounds to fight them on this, but in order to do so, if they do not relent it may be necessary to undergo an action in housing court.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
