Pre Existing childs pet

I moved in to a new apartment. Landlord was aware my son and i had a dog, he never said no just hemmed and hawed about past bad experiences. so i said that she was currently with my signifigant but if he was unable for any reason to care for her that she would be with us, and that we would not get rid of her. only about a week after we moved in my signifigant could not keep her so she came with us. it has been over 3 months, the landloard enters the apartment monthly for the rent, the tenants below me care for her. so she is not hidden, actually the neighborhood pet. can he keep my son and i from a preexist pet?
