Legal Question in Landlord & Tenant Law in New York

I am renting an apartment to a tenant that I consider to be unruly. I recently inspected the apartment that there had been some damage done to the apartment. When I told them I wanted them to pay for it, they refused saying that it is the landlord's responsibility to fix any damage. They have a lease that runs until the middle of next year. What is the best way to proceed with this situation?

I am asssuming that the tenant continues to pay rent. Therefore, I would create an evidence trail. In other words, I would send a certified letter to the tenant explaining that he or she damaged the apartment and that you expect it fixed before the expiration of the lease.

When the lease expires and the tenant leaves, you would be able to use the letter in court to demonstrate that the tenant received notice concerning the damage to the apartment.
