Legal Question in Landlord & Tenant Law in New York

retaining rent money

Hi I have gave a person renting out apartment first month and security to move in. but i unable to because the house was being inspected and is illegal. I wanted my money back they refuse to return my money. The person who rented it to me doesnt even own the house as i later found out. I have sued the person and was told the only way i can get my money back is if the person has a job or bank account. However, they don't have neither. What can I do next. Am i able to sue the owner? How can i go about getting my money back

Re: retaining rent money

You can try to sue the owner if the owner hired that person you paid to act as his/her real estate or rental agent.

As for the judgment you have against that person, you can enforce it against any asset he or she may own wherever it may exist. You may need the assistance of a debt collector to find the assets and enforce the judgment.
