Legal Question in Landlord & Tenant Law in New York

Tenant is a month late on rent and soon to be 2 months, I read online that the judge rulings usually favors the tenant unless it's 3 months of nonpayment. Does it really matter if it's 1 or 3 months before we serve him? Should we accept rent payment after he's served if we want him evicted?
