Legal Question in Landlord & Tenant Law in New York

Wondering if I have a valid lease.

Hello. I live in a side by side duplex.

The person that lives on the other side

began the purchase process of the

house from the owner last August. I

signed a lease with him that was

supposed to begin October 1st 2006.

My rent was raised $200 a month when

that happened. He was turned down by

the bank and had to go through the

whole process two times before he

purchased the house. He did not really

own the house until mid December. I

was on a month to month lease with the

original owner, so he had to give me

back the $400 difference that I had

given him in rent. I was just wondering

if that lease is still binding or if a new

one with the real dates of his ownership

should be drawn up. I am interested in

moving and am totally willing to give

him notice that I want to leave, but I am

wondering if I am still bound to that

lease.

If you are stating that you have a montht to month lease then all that is required for you to leave is to give notice, you should give on month's notice, and then move on... However, you must check your lease, whether it is valid or not, to see what terms it has regarding you leaving the apartment as it may be cause for litigation.
