Legal Question in Legal Ethics in New York

Defense or plaintiff attorneys in a court room for trial sessions are under oath? They do not swear as witnesses are required to. In any case, could they be charged for perjury if they lie?

Q. Defense or plaintiff attorneys in a court room for trial sessions are under oath?

A. No. However, they are officers of the court and have a duty to not lie under the NYS Code of Professional Conduct.

Q. In any case, could they be charged for perjury if they lie?

A. Technically, no. However, they may lose their law license.
