Legal Question in Legal Ethics in New York

is it legal to buy an item in a store, then come back and pick the same item off the shelf and use your reseat from the last item and return the new item for your money back???? what are the charges for this?

i ask because my son has done this and did not get caught, he wants to do it again.

my son is 19.

No, your son has committed larceny, a criminal offense. Larceny consist of taking property that does not belong to you without permission and with the intention of keeping said property.
