Legal Question in Legal Ethics in New York

power of attorney

My material aunt is advanced in age. I am her caregiver an heir to her brownstone property. She gave her attorney the 'power of attorney'.

Can the attorney sell or dispose of the property. My aunt is unable to communicate, and did not recognize the attorney when she visited, senility.

Thank you. --name removed--Steele

Re: power of attorney

Yes.

With a power of attorney the lawyer can sell the building.

If you think that there is a possibility that the attorney would do something underhanded, I would suggest having her declared incompetant by the Court and being appointed legal guardian of her person and property.
