Legal Question in Legal Ethics in New York

My wife and I have been behind on our mortgage payment for about 8 months now. We are constantly trying to negotiate with the bank for a loan modification that has yet to be approved by the lost and litigation department. My wife was in charge of making bills payment including mortgage. We share a joint account where only my paycheck goes but my wife have a separate account where her paycheck goes. She makes a total of $1290 bi-weekly and I make about $ 280 a week. Ever since she stopped paying the mortgage 8 months ago, she can't tell me where all the money she made went. she made a total amount of $20,640 to date combine with my income for the past 8 month which is totaled to $8960 combine to $29,600. I asked her to let me take over the finance so that I can make some types of payment to the bank in order to keep our damage record in good standard with the bank until our modification is approved but she totally ignore my request. Can I sue her to take over the finance if so which court should I go to?

No, you cannot sue your wife over money as long as she is your wife.
