Legal Question in Legal Malpractice in New York

Dropped as a client by lawyer

A law firm had my accident case for two years and then suddenly drops me as a client. I have a feeling that they didn't do anything on my case in that time. Is there anything that I can do? What is the standard for legal malpractice?

I would have to meet with you and get a more detailed statement of facts, etc., before I can advise you.

FYI - I practice in NYC and Long Island.

It depends. I would need more information before giving you a definitive answer. Generally speaking, if the attorneys allowed the Statute of Limitations for your claim to expire, there may be a basis for a legal malpractice claim. In order to know if this happened, I would need to know more information like what kind of accident did you have and who do you claim to be at fault? The Statute of Limitations varies depending on the kind of case and the party to be sued. Also, what were the terms of your retainer? If the attorneys took the case subject to investigation, they may have had the right to withdraw, provided they did not let the time limit expire on your claim.

I would be happy to talk to you about this further. I have experience handling legal malpractice cases and I would be happy to review your case with you.
