Legal Question in Medical Malpractice in New York

Aurgust 07, I went to my dr. complaining of very painful hemmeroids, his nurse din't take any of my vitals and told me I was lucky I caught him before he left for 2 weeks vacation, I was the last apt. He didn't even look at me said he wouldn't touch me because I was in so much pain and gave me a script for cream, he said if I didn't get better I would have to see a specialist. 4 days later I was in the ER with a abcess that burst and I was spectis spent 4 days in ICU where they almost lost me. I had 2 surgeries in 2 weeks I was in the hospital and it turns out I had colon/rectal cancer. Can I do anything about this?

Your claim falls under the failure to diagnose category of medical malpractice claims. A person with such a claim must prove two elements, generally, to sustain a medical malpractice case: 1) liability (whether the doctor deviated from the standard of care) and 2) damages (injuries).

Certainly worth exploring. First step is to meet with a lawyer for an in-depth consultation regarding medical history and treatment, and exactly what transpired at the last appointment. Would be glad to discuss further, if you like. Best, M. E. Zuller; 212-279-8833, ext. 11.
