Legal Question in Medical Malpractice in New York

Is there a case?

Dear Sir,

About 5 weeks ago, I had major surgery. After the surgery when I was brought to a room, the staff gave me an ice pack to keep the swelling down. I was on a drug similar to morphine to relieve the pain and was in and out of a sleep. Later the ice pack opened up because the hospital ice machine was broken and they were wrapping ice in plastic used to line the beds. I stayed in water for possibly a few hours and developed a large bed sore which opened up. I have a scar on my lower part of the back where you sit which is about four inches long by almost 2 inches. Is there anything I can do. I told the nurses and they were upset that this happened to me. Thank you very much.

There may be something you can do. You may have a case against the hospital. You might not even have to prove medical malpractice; these facts could be a simple negligence case.
