Legal Question in Medical Malpractice in New York

Dental Negligence?

Hi,

I recently had dental work done at NYU's clinic.

My student dentist said I needed to have replaced a small piece of Bonding on a lower front tooth (since it was stained). What she did to repair it is to cut out 1/3 - 1/4 of my tooth vs. just removing the speck of Bonding. I was distraught when I picked up a mirror and looked at my tooth when she stepped away.

She filled it as a cavity. Now that tooth is sensitive and doesn't really look better than it did with the Bonding speck.

Can I sue?

Dentists are supposed to perform the least invasive procedures on teeth aren't they???

Please advise me. Thanks.

Re: Dental Negligence?

The answer is it depends. If you would like to sue pro se find a dentist to review your case and find out if the Student Dentist deviated from the standard of care. If so, then go to the pro se section of the local courthouse and ask for help in bringing the claim. The statute of limitations for malpractice is 2 1/2 years.

Best of luck,
