Legal Question in Medical Malpractice in New York

if a doctor has malpractice insurance, is sued and doesn't notify his insurance company, a default judgement is issued, then the doctor goes missing and has a history of depression and is suicidal. Can the insurance company be held responsible because the doctor is mentally incompetent?
