Legal Question in Medical Malpractice in New York

Eclampsia

My 28 year old sister, who was 36 weeks pregnant, had a convulsion. She was rushed to hospital by ambulance and was diagnosed with eclampsia and had an emergency C-section once she was stablized. Her OB doctor told her in the hospital that there were no previous signs of high blood pressure or protein in her urine. However, her previous appointment was 11 days prior to the attack. The day before the convulsion she had called the doctor to complain that she was in pain and her legs were very swollen making it difficult to walk. The doctor told her this was normal and not to overreact. I feel that if he would have seen her that day, this might have been avoided. I feel that the doctor was negligent and we should pursue a malpractice lawsuit. What is the law regarding diagnosing eclampsia and having a trusted physician telling you that everything is normal over the phone without examing you.

Your interest in your sister's welfare is commendable. Without the baby's and mother's chart, as a very preliminary start, it is difficult to tell. Medical malpractice, unlike regular negligence, is very complicated. To say other wise would be to do you and your sister a disservice. I regret that I cannot tell you more.
