Legal Question in Medical Malpractice in New York

heavy metal exposure

my friend and girl friend of 12 years

has been exposed to heavy metals. she was told by her brother they would help her and instead put her in the psych ward.her troulbe is with getting her words out and a short term memory . she been declared totally incompendant.though she been working a full time job with no problems functioning. she really needs help and a good lawyer. any suggestions or help. her heath is in danger and what to resume her treatment she has chosen. they have given her drugs and are harming this poor woman.

This is a very complicated question.

In order for her to be declared totally incompetent there must be two physicians who so certify.

She has a right to have her own physician examine her for competency.

That will then create a controversy, which would then throw the matter into a courtroom.

It is a very fast procedure. A lawyer can even on his own bring a proceeding for her to be released as she is being held against her will. The court could then appoint a psychologist/psychiatrist to examine your friend and report back to the court.

There is also a legal proceeding concerning her right not to take drugs.

So, you see, there is a lot that can be done.

But you should have a lawyer.
