You don't specify the county, but whichever it is, go to the Supreme Court building in the County, and ask to be directed to Surrogate's Court. There is a batch of forms available in the Clerk's office for obtaining Letters of Administration. It's a process. Best, M. E. Zuller

You need to retain a trusts and estates attorney. It is not something that you can do. It is complicated and involves surrogates court.It should cost you anywhere from $2000-$4000. Sorry.

Perhaps, if you have a med mal attorney they could pay for it and call it a disbursement against your future settlement or award. However, most attorneys will not do this unless you have a dynamite case with clear liability and damages.

If you would like... Tell me a little about your case. What happened? How old were they when the alleged malpractice occurred? Did medicaid or medicaire pay any bills? If so, how much? Did your parent have a medical condition before the malpractice occurred, if so what was it? Finally, did your parent support anyone financially? Please answer those questions and I will give you a free opinion as to whether it is worth your time and resources to find out if malpractice actually occured.
