Legal Question in Medical Malpractice in New York

medical malpractice process

what is the initial demand thats requested from the plantiff? is that the amount that the plantiff is suing for? or is the negotiating process still ongoing at that point? and what if the inital demand is far less than what i feel the case is worth, is getting another lawyer at the pre trial stage in my best interest or not please help

Negotiations are always an ongoing process and evolve over time as discovery continues and further information is received. The settlement "value" of a case is dependent on many factors, including the injuries sustained, permanency, future treatment and liability. You should discuss in detail with your lawyer how he or she came to the figure of their initial demand.
