Legal Question in Medical Malpractice in New York

Medicare Lien Estimates

A few months ago Medicare sent a lien estimate to my lawyer and myself (for a medical malpractice case). According to Medicare, the final lien value cannot be determined until the case has settled. Based on your previous experience is Medicare's lien estimate a good indication of what the final lien value will be? Or does the estimate simply denote a minimum amount Medicare will ask on a lien?

I am of course assuming that no new claims were made to Medicare between the time of the lien estimate and settlement. My lawyer doesn't

have much experience with Medicare liens so he couldn't

tell me for sure.

Thank you for your time.

Re: Medicare Lien Estimates

The law has changed a bit in this regard in recent times. I think that Medi. is holding off pending any further/future treatment so that this may, if related to the case, can become part of the lien.

Good Luck
