Legal Question in Medical Malpractice in New York

Surgerical Hernia

My father as a result of a bypass surgery has a hernia ( painful) located just below the sternum. He now is in so much discomfort that this is resulting in another surgical procedure to repair the muscle in the chest. Does he have any legal standing for the inadequate serivces that my father recieved from the prior surgery. Beacuse of his prior heart condition and his age he is at great risk for complications for this corrective surgery. Does he have a legal rememdy?
