Legal Question in Medical Malpractice in New York

My wife went for a Liver Biopsy and the Dr hit her colon with the first needle then with the lidocane injection damaged her 10th/ 11th intercostal nerve whch now resuilts in having a crybation done every 6 to 7 mos for the rest of her life. We have a CD of the 5 passes to the liver and colon but no CD of the shot We have her Doctors

Booth hands of there deptpartment at Stoony Brooke Univeristiy Hospital who say she was treated incorrectly. Do we have a Malpratice suit?
